Relocation of Minor Children


Florida law dictates that all parties who have parental rights to a minor child live within 50 miles of each other.

Florida allows two exceptions to this rule:

  1. If the parties agree that the child can be relocated outside of 50 miles and a written agreement is submitted to the court.
  2. If the party who wishes to relocate submits a Notice of Intent to Relocate with the court which is approved.
If you are a parent with whom the minor child(ren) reside with and you wish to relocate outside of 50 miles from the other parent who have parental rights please be aware that there are specific requirements that must be met in order to satisfy Florida law and have your relocation granted by the court.
